Terms of Service

The standards governing our website and producer-paid casting service.

Agreement and scope

These Terms are a binding agreement between you and Top Notch Casting LLC governing www.topnotchcasting.com and related website services. By using the service or submitting information, you agree to these Terms and the Privacy Policy. These Terms govern the website and preliminary casting process only. Any audition, engagement, performer services, compensation, release, production, content rights, health protocol, or other professional arrangement requires separate terms where applicable.

Adults only

You must be at least 18 years old and legally capable of entering this agreement. The age gate is notice, not final verification. We may request government-issued identification through a separate secure process before an audition or referral. Do not upload an ID through the public application.

Our casting-service role

Top Notch is a producer-paid casting service. We recruit and review adult applicants, may conduct non-explicit auditions, and may provide qualified candidate shortlists to legitimate producers. Unless a separate signed agreement expressly says otherwise, Top Notch does not represent or manage talent, promise or procure employment as a talent agent, employ performers for producers, negotiate performer compensation on the performer’s behalf, operate the producer’s set, direct performances, pay performers, or produce, publish, or distribute adult content.

Producer’s role

The producer makes the final selection and is solely responsible for contracting with, classifying, directing, and paying performers; clearly disclosing the project, acts, boundaries, compensation, dates, location, usage, and distribution; obtaining releases, permits, insurance, and legally required records; maintaining safe working conditions and ongoing consent; and complying with labor, privacy, anti-trafficking, recordkeeping, workplace-safety, and content-production laws.

Talent submissions

Applicants must provide accurate information and submit only material they own or are authorized to provide. An application is preliminary and creates no representation, exclusivity, employment, contractor, partnership, fiduciary, or agency relationship. It does not guarantee review, response, an audition, selection, work, compensation, or any particular outcome. Applicants may refuse or withdraw from an opportunity before entering a binding separate agreement.

Producer inquiries

A producer represents that they have authority to act for the identified production, the project is lawful and involves consenting adults, and all material requirements will be disclosed accurately. Producers may not request undisclosed acts, pressure a performer beyond agreed boundaries, retaliate for refusal or withdrawal of consent, or use candidate information outside authorized casting purposes. We may reject any project presenting safety, consent, legal, or reputational concerns.

Consent and safety

Consent must be informed, voluntary, specific, and ongoing. A website submission, audition, prior performance, relationship, release, or agreement to one activity never implies consent to another. Nothing in these Terms waives a person’s right to establish boundaries or withdraw consent where legally permitted. The website is not an emergency service and does not provide legal or medical advice.

Auditions and prohibited uploads

Initial auditions must be non-explicit. Do not submit sexually explicit material, government IDs, laboratory reports, or medical records through the public application. If later verification is genuinely necessary, Top Notch will provide a separate secure process, purpose-specific notice, and any legally required consent.

Health and testing information

A project-specific testing requirement must be disclosed separately. Testing information does not guarantee that an activity is risk-free. Top Notch seeks to receive only verification status and expiration when practical, rather than complete medical records. Collection or sharing of consumer health data is governed by separate consent and the Consumer Health Data Privacy Policy.

Acceptable use

You may not use the service for unlawful, fraudulent, coercive, exploitative, discriminatory, defamatory, or abusive conduct; submit content involving or appearing to involve a minor; upload malware, stolen material, nonconsensual intimate imagery, or infringing content; misrepresent identity, authority, age, company, or opportunity; scrape or disrupt the service; bypass security controls; or use candidate information to stalk, harass, exploit, or make unauthorized contact.

Your content

You retain ownership of submitted content. You grant Top Notch a limited, nonexclusive license to host, secure, copy, review, format, and internally display it solely to operate the service, evaluate the submission, communicate with you, prevent abuse, comply with law, and consider candidates or projects. This does not authorize public distribution, commercial exploitation, adult-content production, or transfer of publicity rights; those require a separate written agreement.

Intellectual property

Top Notch branding, logos, website design, original text, graphics, and software are protected by law. No right is granted to copy, modify, distribute, sell, license, or create derivative works from them except for ordinary use of the service.

Privacy and communications

Our Privacy Policy and Consumer Health Data Privacy Policy describe our data practices. By submitting contact information, you consent to transactional communications about the application, inquiry, security, privacy requests, or potential opportunities. Marketing communications, if introduced, will include legally required choices.

Disclaimers

To the maximum extent permitted by law, the website service is provided “as is” and “as available.” We do not warrant uninterrupted operation, complete security, selection, suitability, accuracy, safety, legality, or availability of any applicant, producer, project, test result, or opportunity. Nonwaivable legal rights remain unaffected.

Liability limitation

To the maximum extent permitted by law, Top Notch and its personnel will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages or lost profits, data, or opportunities arising solely from the website service. Aggregate liability will not exceed the greater of amounts paid specifically for the website service during the preceding six months or $100. These limits do not apply where liability cannot legally be limited, including applicable fraud, willful misconduct, gross negligence, infringement, or personal injury.

Governing law and venue

Washington law governs these Terms, without regard to conflict principles, except where federal law or nonwaivable law applies. A dispute arising solely from the website service must be brought in a court with jurisdiction in the Washington county where Top Notch maintains its principal place of business. Project-specific agreements may contain different provisions.

Changes and general terms

We may update these Terms prospectively, suspend access for material violations or safety threats, and modify website features. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder continues. These Terms do not replace a separate signed agreement.
